Respect for Intellectual Property
Bear Market News respects the intellectual property rights of others and expects our users and contributors to do the same. This policy outlines our procedures for addressing claims of copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA) of the United States and the Canadian Copyright Act (R.S.C., 1985, c. C-42).
While Bear Market News is a Canadian company, we voluntarily comply with DMCA provisions to provide a clear and efficient mechanism for resolving copyright disputes, given the international nature of online content.
Notification of Copyright Infringement
If you believe that any content on bearmarketnews.net infringes your copyright, you may submit a written notification (“Takedown Notice”) to our Designated Copyright Agent. Your Takedown Notice must include the following information, as required by 17 U.S.C. § 512(c)(3):
- Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, provide a representative list.
- Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate the material on the Site. Please provide the specific URL(s) where the material appears.
- Your contact information: full legal name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Your physical or electronic signature.

Counter-Notification Procedure
If you believe that material you posted on the Site was removed or access to it was disabled as a result of a mistake or misidentification, you may file a counter-notification. Your counter-notification must include:
- Identification of the material that has been removed or disabled and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., the District Court for the Southern District of New York), and that you will accept service of process from the person who provided the original Takedown Notice.
- Your physical or electronic signature.
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Bear Market News has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We may also, at our sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
A “repeat infringer” is defined as a user about whom Bear Market News has received two or more valid Takedown Notices that have not been successfully countered.
Fair Use and Fair Dealing
Not all uses of copyrighted material require permission. Under U.S. law, the fair use doctrine (17 U.S.C. § 107) permits limited use of copyrighted material without authorization for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. Under Canadian law, the fair dealing provisions (Copyright Act, sections 29-29.2) serve a similar function.
Before submitting a Takedown Notice, please consider whether the use of your work might qualify as fair use or fair dealing. We encourage rightsholders to carefully evaluate fair use/fair dealing considerations before initiating a takedown request.
Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys’ fees. We take misrepresentation seriously and reserve the right to seek damages from anyone who abuses the DMCA process.
Canadian Copyright Act
In addition to DMCA compliance, we adhere to Canada’s notice-and-notice regime under the Copyright Modernization Act (Copyright Act, sections 41.25-41.27). Under this regime:
- We forward copyright infringement notices to the alleged infringer upon receipt
- We retain records of notices for the prescribed period (currently 6 months for the notice, 1 year for identifying information)
- We do not disclose identifying information without a court order

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting. We encourage you to periodically review this policy to stay informed of any updates.
